Beverage group, businesses sue NYC over sugary drink ban

NEW YORK (Reuters) - Soft drink makers and a restaurant group filed a lawsuit on Friday seeking to block New York Mayor Michael Bloomberg's upcoming ban on large sugary drinks.

The mayor's Board of Health overstepped its authority when it passed the regulation, the lawsuit said. The power to approve such legislation lies solely with the city council, it said.

The plaintiffs include the American Beverage Association and the National Restaurant Association, along with a number of unions and pro-business groups.

The ban, the first of its kind in the United States, outlaws the sale of sugary drinks larger than 16 ounces everywhere in New York City except grocery and convenience stores. It is the latest step in Bloomberg's quest to combat obesity. Previously, he has required chain restaurants to post calorie counts on their menus and banned trans fats citywide.

The soft drink and restaurant industries have said the ban is an infringement of personal freedom, and cited polls that show a majority of New Yorkers oppose the restriction. A legal fight has been expected ever since Bloomberg proposed the ban in May.

The lawsuit, filed in state court in Manhattan on Friday, asks the court to bar the law before it can take effect next March.

"This case is not about obesity in New York City or the motives of the Board of Health in adopting the rule being challenged," the lawsuit said. "This case is about the Board of Health, appointed by the mayor, bypassing the proper legislative process for governing the city."

The lawsuit also claims the rule is "arbitrary and capricious," because it applies only to some businesses and targets only certain types of beverages.

"Delis and hotdog stands are barred from selling a 20-ounce lemonade, but the 7-Eleven a few feet away remains free to sell Big Gulps," the lawsuit said.

Several legal experts, however, have said they expect any court challenge to face an uphill battle, given the health department's power to regulate eateries in the city.

Marc LaVorgna, Bloomberg's chief spokesman, said the "predictable, yet baseless" lawsuit will put an even greater spotlight on an obesity epidemic that kills 6,000 New Yorkers a year.

City officials have cited public health statistics showing that 58 percent of the city's adults and nearly 40 percent of public school students are obese or overweight.

The ban defines a sugary drink as a beverage that includes sugar or another caloric sweetener, has more than 25 calories per 8 ounces, and does not contain more than 50 percent of milk by volume.

The case is New York Statewide Coalition of Hispanic Chambers of Commerce et al. v. The New York City Department of Health and Mental Hygiene et al., 653584/2012, New York State Supreme Court, New York County.

Ryan rejects need for breakthrough moment

WASHINGTON (AP) ? Mitt Romney's running mate shot down the need for a breakthrough in the first presidential debate Wednesday, trying to allay Republican concerns that the race is slipping away with five weeks to go and momentum on President Barack Obama's side.

Vice presidential nominee Paul Ryan, working to keep debate expectations for Romney in check, praised Obama's debating skills and called the Democratic incumbent "a very gifted speaker" with years of experience on the national stage. He played down signs that Obama is gaining distance in the most competitive states. Polls are tight, Ryan said, and will stay that way until the election Nov. 6.

"We're running against an incumbent president with incredible resources," Ryan said. "More importantly, I don't think one event is going to make or break this campaign."

At a rally in Las Vegas Sunday, President Barack Obama was tamping down expectations himself, downplaying his own oratorical skills while praising Romney's.

"Gov. Romney, he's the debater. I'm just OK," Obama said.

Earlier Sunday a prominent Romney supporter said he expected Romney's performance in Denver on Wednesday night would shake up the campaign after a "tough couple of weeks." Gov. Chris Christie, R-N.J., predicted Romney would do "extraordinarily well" in the debate, and that come Thursday morning, "this whole race is going to be turned upside down."

Romney is trying to rebound from a difficult September, and the three October debates offer a chance to help show that the race is winnable. Christie, who passed on a 2012 run for the White House but is a possible contender in 2016, called the domestic policy and economic debate in Denver "the restart of this campaign."

That confidence from a high-profile backer comes even as Americans are growing more optimistic about the economy and Obama's leadership, creating a significant obstacle for Romney.

Polls show Obama with a steady lead in many of the nine states where the candidates are competing most fiercely. If the election were held today, an Associated Press analysis shows Obama would win at least 271 electoral votes, enough for re-election. The analysis is intended to provide a snapshot of a race that until recently has been stubbornly close in the small number of the most contested states.

At an evening rally in Las Vegas, the president said that while some people might be focused on who has the best "zingers" in the debate, he was focused on having a serious discussion about the nation's future.

"That is what people are going to be listening for," he said. "That's the debate you deserve."

Obama drew more than 11,000 people to the evening rally in the Western battleground state. The event was aimed in part at boosting enthusiasm among Hispanics, a key source of support for Obama in Nevada. The popular Mexican rock band Mana performed ahead of the president's remarks.

Obama is staying in Nevada as he prepares for the debate. Accompanying him was a cadre of advisers assisting with debate prep, including chief of staff Jack Lew, top economic adviser Gene Sperling, pollster Joel Benenson and speechwriter Jon Favreau. Sen. John Kerry, D-Mass., who is playing Romney in debate prep, was traveling to Nevada separately.

Romney remained in Boston on Sunday, going through preparations of his own for Wednesday's event.

The former Massachusetts governor wrote an opinion piece on foreign policy Sunday in the Wall Street Journal, accusing the Obama administration of minimizing the seriousness of the attack on the U.S. Consulate in Libya and the other threats facing the U.S. in the region.

Romney writes, quote, "our values have been misapplied ? and misunderstood" by Obama. He also says Obama has distanced the U.S. from Israel.

In a statement released late Sunday Philips Electronics said they were pulling out as sponsors of the presidential debates.

"While the Commission on Presidential Debates is a nonpartisan organization, their work may appear to support bi-partisan politics," Mark A. Stephenson, head of corporate communications for Philips North America, said in the statement. "We respect all points of view and, as a result, want to ensure that Philips doesn't provide even the slightest appearance of supporting partisan politics."

At issue is the commission's decision to limit the debates to the two main party candidates.

The Commission on Presidential Debates could not be reached for comment Sunday.

Ryan, a Wisconsin congressman, said on "Fox News Sunday" that the debate would mark Romney's debut "on this kind of stage." Romney participated in more than two dozen multicandidate debates during White House runs in 2008 and 2012, and went one-on-one against Sen. Edward Kennedy, D-Mass., during a losing 1994 Senate bid.

"They expect to come out of this with the race fundamentally changed. Now, what does that mean?" asked David Plouffe, a senior White House adviser. "If it's going to fundamentally change, that means in seven or 10 days from now you'll see states like Ohio tied, the state of Iowa tied because that's what really matters here. So they have set the bar quite high."

Christie said Romney needs to "tell the truth about what's going on" in the country while laying out "a positive and hopeful vision for the future."

"I think he can do both. Listen, Mitt Romney can walk and chew gum at the same time. I'm not worried," Christie said.

Ryan acknowledged errors by the campaign but urged Republicans who are publicly carping to join him on the trail to witness the forceful case they're making.

"We've had some missteps, but at the end of the day, the choice is really clear," Ryan said, adding that up until now, he and Romney "have not been able to frame that choice as clearly."

The campaign has suffered from the release of a hidden-camera video of Romney calling 47 percent of Americans victims who depend on government help. Almost two weeks after the video's release, the matter continues to dog Romney, featuring prominently in Obama's campaign ads.

Republicans, meanwhile, continued challenging Obama's foreign policy, saying his approach had contributed to unrest across the Middle East. Ryan cited Syria, Iran, Russia and Israel as countries where the "ugly fruits" of Obama's policies are unraveling.

Romney, speaking to voters in a podcast released Saturday, faulted Obama for presiding over a decline in the nation's moral standing and a retreat of American leadership. "President Obama's foreign policy is one of passivity and denial," Romney said. "And that places America and our friends and allies at the mercy of events and those who mean to do us harm."

Ryan, looking ahead to his lone debate on Oct. 11, said he expected Vice President Joe Biden would be highly disciplined despite a reputation for verbal slip-ups,

"He's fast on the cuff. He's a witty guy. He knows who he is and he's been doing this for 40 years," said Ryan. "You're not going to rattle Joe Biden."

Plouffe appeared on NBC's "Meet the Press" and ABC's "This Week." Christie spoke on NBC, ABC and CBS' "Face the Nation."

Hedge-fund manager Philip Falcone is back at the FCC's doorstep with yet another proposal, which he hopes might snatch the maligned network from the jaws of GPS interference-related troubles. Two filings placed with the commission apparently outline plans to use its broadband network in a way that it believes won't interfere with GPS signals, along with the 5MHz of spectrum that are known not to cause any issues. Along with the proposed changes, LightSquared is reportedly set to ask for more time to have exclusive rights to propose a reorganization plan. If granted, this could finally mean some progress for the beleaguered project, but with investors worried that money being spent on this could be better-placed back in their pockets, Falcone will have everything crossed, while the FCC deliberates the situation.

Online dating: It is not that hard, and yet so many people make it so hard. I?ve been documenting OKCupid atrocities for a while now, and a lot of themes crop up in the terrible messages that daters send me for, um, critiquing. This is how to send a semi-decent online dating message in nine easy steps.

One paragraph
A one-sentence message probably isn?t saying enough, but you also don?t want to send a?novel. Responding to a few items in a person?s profile will take somewhere between three and eight sentences; if you find yourself writing a?six-paragraph missive, work that delete key.

Be original
We can tell?when your message is?copied and pasted?to multiple people. Sure, it?s a pain to actually read through profiles and send unique messages to each person, but aren?t you here to find a date? Learn a little something about the person you?re messaging, and reference that in your communiqu?. ?Hey gurl, luv ur pics? is not going to get a response. More likely to get a response: a message that is directly responsive to several things in the object of your affection?s profile.?

If you?re sending a message, the recipient already knows you?ve looked at their pictures and find them attractive. So instead of stating the obvious, point to what it was that attracted you to their personality (or at least the fragment of their personality that they put on the Internet).

Does her profile say she?s a lesbian and you?re a straight guy with a weakness for?Justin Bieber haircuts? Sorry pal, but she?s not gonna be into you, no matter how appealing her floppy hair is. Do you live in Tennessee and are up for some long-distance chatting but she?s in New York and wants someone local? Move on to someone who?s interested in people of your gender, location, age, etc. The beauty of Internet dating is that we all get to specify what we want. Respect that and don?t waste anyone?s time ??including your own.?

You would think ?don't be a jerk? would be obvious, but there are apparently?legions?of people (mostly dudes) who adopt crappy pickup-artist tactics in their online dating lives, and think they might get lucky by sending vaguely (or?blatantly) insulting messages to unsuspecting recipients (negging?is actually a thing!). Is there some low-self-esteem lady out there who might respond to a message about how ugly she is? Sure, maybe, but the odds are slim ? and since this is the Internet, even women who have been strongly socialized to be nice to cretins in bars are able to hit the delete key. You?re better off ditching the crappy, manipulative dating tactics and sending a nice, normal message.?

Unless both of you make it clear in your profiles that you are on this site for sex and only sex, keep the message PG ??yes, even if there?s a mention of something sexual in the person?s profile, and yes, even if you think your sexual reference is cute or funny or clever. We all want to get laid and we all have our sexual proclivities, and if we like something in particular we may mention it on our dating profile. But even if there?s a recognition that we, like almost every other adult human being, sometimes enjoy having our genitals touched, there?s no need to go all porno upon first introduction. There?s no need to go even a?little bit?porno. Until you?ve gone actual porno in real life, leave the porno-chat alone.

Keep it positive
No one wants to date sad-sack, and no one wants to hear about your terrible past dating life the first time they talk to you. We?re all Internet dating here ??it follows that we are all single and perhaps don?t want to be. So don?t whine about your lack of a love life, don?t lament the fact that you?re such a?nice guy?but women are such harpies, and definitely?don't threaten to kill yourself?because you?re lonely. Sell yourself! If you want extra credit (and a better chance at a response) be a little bit witty. Remember that nearly everyone likes someone who takes an interest in them. So respond to what?s in their profile and ask a question or two. Don?t make it The Sad-Face Show. Keep it breezy.

Stick to these rules, be kinda funny, try not to be a clich? machine (you love to laugh and couldn?t live without your family and friends?! OMG ME TOO!) and your profile should be at least marginally acceptable (and hopefully won?t end up here for the wrong reasons).
