VIA Technologies sues Apple for patent infringement

Seems like we can't go a week without another patent infringement lawsuit being filed, and this one's no different. Apparently, VIA Technologies, maker of fine computational processors, is mad as hell with Apple's allegedly infringing ways, and it's not gonna take it anymore. Filed in the US District Court in Delaware, VIA claims that Cupertino's iThings and Apple TVs infringe patent numbers 6,253,312, 6,253,311 and 6,754,810, which cover various microprocessor functions. A complaint's also been lodged with the ITC -- in order to hasten the settlement talks, no doubt. So, all that's left is the countdown until these two shake hands, exchange checks and go on about their business... preferably outside the courtroom.

But, seeing your wholeness as dependent on the presence of this other person poses potential problems for both of you.

The obvious is that your seeing, feeling and being whole is completely dependent on that person. And they are elevated in your eyes to provide you with a lasting job that they can never really fulfill?making you what you are not?whole.

Sounds like circular talk? It?s not really circular; it is self-evident, especially when you are walking in these shoes.

Both parties in abusive relationships can be guilty of this thinking and from here, they place unrealistic expectations on one another.

Complementing Batterer and Abused

The batterer can look to his partner as his emotional security blanket, or as the caretaker of his unidentified and unexpressed feelings. And the abused can look to the batterer as the bully that protects her from dangers outside of the home and, in some cases, from life?s responsibilities in general.

The projected message to the other person is that they serve to do for you what you aren?t naturally providing for yourself. The trouble in this thinking comes when you stumble upon your integration of what the complementing partner offers you.

Your difficulty in assimilating and integrating what you get from your partner?that you yourself don?t internally own?is that when you put it on, it doesn?t fit.

It can?t truly fit?no matter how fitting it is?because you don?t ?really? own it in yourself.

In domestic abuse interventions, we work with this dynamic within the relationship and the challenge becomes how to help each person individually to find their wholeness within themselves. General Mills 1Q profit falls as revenue rises (AP)

MINNEAPOLIS ? General Mills Inc.'s fiscal first-quarter net income fell 14 percent, but its adjusted results beat Wall Street's expectations as revenue climbed on higher prices, solid demand and new products.

The Minneapolis-based food maker also reaffirmed its full-year adjusted earnings outlook.

The maker of Cheerios cereal and Haagen-Dazs ice cream said Wednesday that its net income fell to $405.6 million, or 61 cents per share, for the period ended Aug. 28, down from $473.6 million, or 70 cents per share, a year earlier.

Removing special items, adjusted earnings came to 64 cents per share.

This topped the 62 cents per share that analysts surveyed by FactSet predicted.

Revenue rose 9 percent to $3.85 billion from $3.53 billion, beating Wall Street's forecast of $3.81 billion.

The period included one month of results for Yoplait, which the company acquired a controlling stake in during the quarter.

General Mills announced in May that it would pay $1.15 billion to acquire a controlling interest in the yogurt company from a French investment firm and dairy group.

General Mills said the Yoplait deal added 3 percentage points to its revenue increase.

Aside from Yoplait, Chairman and CEO Ken Powell said in a statement that increased prices, resilient consumer demand for existing products and a good early response to new products that debuted in the quarter all contributed to its revenue performance.

Revenue for the company's U.S. retail division increased 3 percent to $2.51 billion.

Cereal sales edged up 1 percent, helped by brands such as Chex and Cinnamon Toast Crunch. New products included Cinnamon Burst Cheerios, Cocoa Puffs Brownie Crunch and Fiber One 80 calorie cereal also added to results.

At the snacks unit, sales rose 17 percent, driven by Nature Valley and Fiber One snack bars. Sales for the baking products division increased 5 percent, while Pillsbury segment sales gained 4 percent.

The Small Planet Foods division reported a 13 percent sales increase, helped by Cascadian Farm cereal and Larabar.

Results were disappointing for the meals unit, which posted a 4 percent sales decline due to lower shipment volumes for dinner mixes, canned vegetables and soup. Yoplait sales fell 3 percent.

General Mills' overseas performance was strong, with revenue up 30 percent to $856 million. The results were propelled by strength in Europe, which reported a 36 percent gains. This was followed by a 15 percent gain for the Asia/Pacific region and a 12 percent increase for Latin America. Canada posted an 8 percent increase.

Bakeries and foodservice segment revenue rose 13 percent to $481 million, with sales to bakeries and national restaurants up 18 percent.

Powell predicts General Mills' earnings will rise over the next nine months. The company maintains that hits fiscal 2012 adjusted earnings will come in between $2.59 and $2.61 per share.

Analysts expect earnings of $2.61 per share for the year.

Rescue workers search for survivors of Himalaya quake

GUWAHATI, India (Reuters) - Rescue workers with sensors and sniffer dogs searched through the rubble on Wednesday for more survivors of an earthquake that has killed at least 92 people in a remote Himalayan region spanning India, Nepal and the Chinese region of Tibet.

More than 3,000 people have been rescued in the Indian state of Sikkim, the epicenter of the 6.9 magnitude quake, since Sunday in operations hampered by heavy rain, thick clouds and landslides that cut off some of the worst affected areas.

Remote areas near the state's northern border with Tibet remain out of reach as rain washed away roads that are now being hastily rebuilt by hundreds of construction workers. About 45 tourists are among those holed up in the area, while workers at a hydroelectric plant remain unaccounted for.

"The death toll is likely to go up," S.K. Pradhan, a senior bureaucrat stationed in north Sikkim, told Reuters.

"I think it will take a long time to restore the road communications in some areas."

The quake, which was felt as far away as New Delhi in India and Bangladesh, killed at least 78 people in India alone. In Tibet at least seven died and seven more were killed in Nepal.

RAHUL GANDHI VISIT

Ruling Congress party heavyweight Rahul Gandhi, seen by his supporters as India's next prime minister, touched down on Wednesday in an air force helicopter in Gangtok, state capital of Sikkim, to meet some of the victims.

The son of Sonia Gandhi, the head of India's ruling Congress party, helped manage the party when his mother was recently in the United States for undisclosed surgery, but Rahul is still seen as inexperienced.

The ruling party has been battered by graft scandals and protests that have sparked sharp criticism of the government.

He has won some favorable media coverage in the past for visits to poverty-stricken families, but whether the latest appearance in the quake-hit region could win voter support remains unclear.

"Columnists are declaring not just the beginning of the decline of India's Grand Old Party (GOP), but also the fading luster of Rahul Gandhi, the youth icon projected by the Congress as the face of the future," the Times of India newspaper said in a column on Wednesday.

Rescue workers are trying to airlift survivors out of the worst affected areas and distribute food and medical supplies in the country's least populous state of 600,000 people. Sikkim is poorly connected by road and has no airport.

"In Gangtok, a few buildings have collapsed and larger buildings like the secretariat and some shopping malls have been sealed as they have developed cracks," Deepak Pradhan, a resident of the state capital told Reuters by phone.

"The roads have opened, but a lot of these landslides have occurred due to poor maintenance."

The state's economy boomed in recent years as it opened up to tourism and trade with China. Residents say landslides are a threat to hastily built new buildings in its mountain towns.

For centuries a rarely visited Buddhist kingdom known for the world's third highest peak on its border with Nepal called Kangchenjunga and glacial lakes, Sikkim joined India in 1975. With 600,000 residents, it is the least populated state and borders Bhutan, Tibet in China and Nepal.
